What is an H-1B Visa?

The H-1B visa is a non-immigrant visa that allows U.S. companies to employ foreign professionals in specialty occupations that require theoretical or technical expertise. Specialty occupations typically require a bachelor's degree or higher (or its equivalent) as a minimum entry requirement.

H-1B Visa Requirements

• You must have a job offer from a U.S. employer for a specialty occupation

• Your employer must obtain a certified Labor Condition Application (LCA) from the Department of Labor
• The position must be in a specialty occupation related to your field of study
• Your employer must pay you at least the prevailing wage for your position in the geographic area of employment

H-1B Visa Timeline and Process

The H-1B visa process typically involves the following steps:

1. The employer submits a Labor Condition Application (LCA) to the Department of Labor
2. Once the LCA is certified, the employer files an H-1B petition with USCIS
3. If the petition is approved, you apply for a visa at a U.S. consulate (if abroad)
4. Upon approval, you can begin work for the sponsoring employer

For new H-1B visas subject to the annual cap, petitions can only be filed during the registration period, typically in March, for employment beginning in October of the same year.
