H-1B Visa Timeline and Process
The H-1B visa process typically involves the following steps:
- The employer submits a Labor Condition Application (LCA) to the Department of Labor
- Once the LCA is certified, the employer files an H-1B petition with USCIS
- If the petition is approved, you apply for a visa at a U.S. consulate (if abroad)
- Upon approval, you can begin work for the sponsoring employer
For new H-1B visas subject to the annual cap, petitions can only be filed during the registration period, typically in March, for employment beginning in October of the same year.
