1. International Recognition

2. At Least Three Years of Experience

You must have at least three years of experience in teaching or research in your academic field. Experience gained during a degree program may count if:

  • You had full responsibility for courses taught
  • The research conducted toward the degree has been recognized as outstanding
  • You received the degree, and the research was essential to it

3. Job Offer from a Qualifying Employer

You must have a job offer for:

  • A tenured or tenure-track teaching position from a university or institution of higher education, OR
  • A comparable research position at a university or higher education institution, OR
  • A research position with a private employer that has at least three full-time researchers and documented accomplishments in your academic field

4. Evidence of Outstanding Achievement

You must meet at least two of the following six criteria:

  1. Receipt of major prizes or awards for outstanding achievement in your academic field
  2. Membership in associations that require outstanding achievements for membership
  3. Published material in professional publications written by others about your work
  4. Evidence of your participation as a judge of the work of others in the same or an allied field
  5. Original scientific or scholarly research contributions to the academic field
  6. Authorship of scholarly books or articles in scholarly journals with international circulation

The EB-1B Application Process

The EB-1B application process typically involves the following steps:

Step 1: Employer Petition

Your employer must file Form I-140, Immigrant Petition for Alien Worker, on your behalf with USCIS. The petition must include:

  • Evidence of the employer's qualifications as a qualifying institution
  • A job offer letter detailing the permanent position
  • Documentation of your international recognition and at least three years of experience
  • Evidence meeting at least two of the six criteria for outstanding achievement
