EB-1A Extraordinary Ability

The EB-1A visa category is reserved for individuals who possess extraordinary ability in the sciences, arts, education, business, or athletics. Our experienced immigration legal team can help you document your achievements and navigate this prestigious path to permanent residency.

What is the EB-1A Extraordinary Ability Category?

The EB-1A is a first-preference employment-based immigration category for individuals who can demonstrate extraordinary ability in their field. This prestigious category offers several advantages, including the ability to self-petition without an employer sponsor, no labor certification requirement, and priority processing times.

"Extraordinary ability" is defined as a level of expertise indicating that the individual is among the small percentage who have risen to the top of their field of endeavor. The applicant must demonstrate sustained national or international acclaim and that their achievements have been recognized in their field.

EB-1A Eligibility Criteria

To qualify for an EB-1A green card, you must meet either:

  1. Evidence of a one-time achievement such as a major internationally recognized award (e.g., Nobel Prize, Academy Award); OR
  2. Evidence of at least 3 out of the following 10 criteria:
  • Receipt of lesser nationally or internationally recognized prizes or awards for excellence in your field
  • Membership in associations that require outstanding achievements of their members, as judged by recognized national or international experts
  • Published material about you in professional or major trade publications or other major media
  • Serving as a judge of the work of others in your field (either individually or on a panel)
  • Original scientific, scholarly, artistic, athletic, or business-related contributions of major significance in your field
  • Authorship of scholarly articles in professional or major trade publications or other major media
  • Display of your work at artistic exhibitions or showcases
  • Performance in a leading or critical role for organizations or establishments with distinguished reputations
  • High salary or other significantly high remuneration in relation to others in the field
  • Commercial successes in the performing arts

In addition to meeting at least 3 of the 10 criteria, you must demonstrate that you will continue to work in your area of expertise and that your entry will substantially benefit the United States.

The Two-Step Analysis

USCIS applies a two-step analysis to EB-1A petitions:

  1. Initial Evidence: Determine if the petitioner has submitted the required initial evidence, including documentation for at least 3 of the 10 criteria.
  2. Final Merits Determination: Evaluate the totality of the evidence to determine if it demonstrates a level of expertise indicating that the individual is among the small percentage who have risen to the very top of the field and has sustained national or international acclaim.

Advantages of the EB-1A Category

The EB-1A offers several significant advantages over other employment-based green card categories:

  • No requirement for an employer sponsor (can self-petition)
  • No labor certification or PERM process required
  • Priority processing with shorter waiting times
  • Current priority dates for most countries
  • Premium processing available for expedited adjudication
  • No specific degree or work experience requirements
